Kilmar Abrego Garcia Returned: What Really Happened in the El Salvador Case?

Kilmar Armando Abrego Garcia, a Maryland resident and Salvadoran national, has been returned to the United States after his controversial and mistaken deportation to El Salvador earlier this year. The 29-year-old, who had lived in the U.S. since age and was legally protected from deportation due to the threat of gang violence in his home country, was removed in March 2025 despite a court order forbidding his removal.

After months in El Salvador’s maximum-security prison, Abrego Garcia was brought back to the U.S. following a Supreme Court ruling that his deportation was illegal. The Trump administration had argued it lacked authority to secure his return, but the Court rejected this, leading to a diplomatic negotiation with El Salvador’s government.

Upon his return, Abrego Garcia appeared in a Tennessee federal court to face two criminal charges: conspiracy to transport undocumented migrants and unlawful transportation of undocumented migrants for financial gain. The indictment alleges he participated in a yearslong operation moving migrants from Texas to other parts of the U.S. between 2016 and 2025 If convicted, he will serve his sentence in the U.S. before being deported again to El Salvador.
